HARRIS COUNTY APPRAISAL DIST. WARNS HOMEOWNERS TO BE WARY OF HOMESTEAD DESIGNATION AND UNCLAIMED MONEY SOLICITATIONS

The appraisal district is regularly contacted by homeowners who have unnecessarily paid money to solicitors who--for a fee--offer to file "designation of homestead" and/or homestead exemption forms in Harris and other counties.

Additionally, many homeowners complain after being misled by letters from individuals or businesses that offer to help them recover unclaimed government funds if the homeowner signs an agreement giving the solicitor half the recovered money. In the typical case of this type, the homeowner simply receives a property tax homestead exemption application form prepared by the firm doing the solicitation.

Unfortunately, once the homeowner has agreed to pay the solicitor half the refund, he or she loses that much of any potential tax refund and many of these firms have been quick to sue in small claims court if the unfortunate individual refuses to pay.

Jim Robinson, HCAD's chief appraiser, urges homeowners who receive these types of solicitations to be extremely careful and check with the appraisal district or an attorney before responding to the offer.

"There is absolutely no charge for a homeowner to file his or her own homestead exemption application with the appraisal district, and application forms are available both on HCAD's website and from the district's Information & Assistance Center at 13013 Northwest Freeway in Houston," Robinson noted.

The homestead exemption is the single most important tax saver available to homeowners. You are eligible if you meet these requirements:

1.  You owned and occupied your home on January 1 of the year for which application is made.

2.  Neither you nor your spouse has claimed a residence homestead exemption on any other property, regardless of where that property is located.

A qualified property owner may apply up to one year after the date taxes for the year of application become delinquent (usually February 1).

Homeowners who are over-65 or totally and permanently disabled (as defined by Social Security) are eligible for additional exemptions, and become eligible on the date they turn 65 or become disabled.

In the case of solicitations offering to file a "Designation of Homestead", this sort of form is submitted to the county clerk rather than the appraisal district, and does not qualify as a property tax homestead exemption application. This sort of designation deals only with protecting one's homestead property in the event of a forced sale for debt. Most homeowners never need to file such a designation and, generally, should consult an attorney before doing so.

La oficina de valores es contactada regularmente por propietarios que innecesariamente han pagado dinero a agentes que por dicha cuota ofrecen archivar o llenar el formulario "Homestead Exception" en el condado de Harris y otros condados.

Dicho a lo hecho, muchos propietarios se quejan después de ser engañados por estas cartas de individuos o negocios que ofrecen ayudarlos. Sin embargo lo que realmente estos negocios o individuos están haciendo es tomar la mitad del reembolso correspondido. Si el propietario firma un contrato con dichos solicitadores el propietario solo recibirá un formulario de solicitud para el "Homestead Exception," llenada por la agencia solicitadora.

Desafortunadamente, una vez que el propietario ha aceptado a pagar al agente, usted perderá la mitad del rembolso disponible. En muchos casos si el propietario se niega a pagar al agente, el agente pone una demanda a la cual se puede llevar a corte por negarse a pago.

Jim Robinson, valuador principal de HCAD, insiste a propietarios que reciben estos tipos de solicitaciones para ser muy cuidadosos y reasegurarse con la oficina de valores o un abogado antes de responder a la oferta.

No hay absolutamente ningún cargo para el propietario al archivar su propia aplicación de "Homestead Exception" con la oficina de valores. Los formularios de solicitud están disponibles en la página web de HCAD y en el Centro de Asistencia e Informativo en la oficina de valores, en el 13013 Northwest Freeway en Houston.

El formulario "Homestead Exception" es la más importante para ahorrarse en los impuestos, y usted puede ser elegible si cumple con estos requisitos:



1. Si poseo y ocupo su casa el día 1or de enero del año en cual la aplicación es sometida.

2. Si usted o su cónyuge no ha reclamado "Homestead Exception" para la vivienda actual o cualquier otra propiedad en el mismo año.



Propietarios que califican puede aplicar hasta un año después antes de que los impuestos de la fecha para el año de aplicación lleguen a ser delincuentes (generalmente 1or de febrero).

Los propietarios con edad de 65 años o más, o totalmente y permanentemente discapacitados (como define la oficina del Seguro Social) tienen derecho a exenciones adicionales y son elegibles, des de el momento de cumplir los 65 años de edad o al ser discapacitado.
